Sailor shot by officer sues Norfolk for $5 million

NORFOLK, Va. (WAVY) 10 On Your Side has learned a Sailor shot by Norfolk police is taking legal action, and she s asking for $5.3 million. The lawsuit was filed in Norfolk Circuit Court on January 9, claiming negligence against the officer.

I think that anytime you deal with a lawsuit, it s concerning, Norfolk City Councilman Andy Protogyrou told WAVY.com.

Protogyrou acknowledges 2014 was a tough year for the Norfolk Police Department. It lost one of its own.

There was a police boat accident that injured more than a half dozen people. Then there were several police-involved shootings, followed by an incident this year when a Norfolk State University student was attacked by a police K-9.

We can demand perfection from our staff, but we are human beings, Protogyrou said. We are not going to get perfection.

Sailor Jasmine Glespie was shot August 3 on Glen Myrtle Avenue.

Police were there to break up a party. Glespie is claiming police officer M.A Hutson used excessive force. The lawsuit says Hutson never announced himself and completely neglected the safety of another person.

10 On Your Side asked Protogyrou about not only the lawsuit, but also the perception of the city.

There were four officer-involved shootings last year; two were ruled to be justified, but the others are still being investigated by the Norfolk Commonwealth s Attorney.

To say it s a black eye, I can t agree with you on that, Protogyrou said. You have each incident in and of itself, and it doesn t necessarily make the whole.

Protogyrou said lawsuits against the city are going to happen, but it s important in situations like Glespie s to let the process play out.

A couple of those investigations are still open, and we have not received the facts on it, Protogyrou said. Some of our investigations are in litigation, so when that happens, we have to look at that side.

Glespie pleaded guilty to drunk driving charges related to the incident when she was shot.

10 On Your side checked the city s online court records, which say the first hearing in her lawsuit against the city is scheduled in April.

10 On Your Side is still waiting on the Commonwealth s attorney investigation on two police-involved shootings.

One is Glespie s and the other was the deadly shooting of David Latham in June.
